In the following, we present our General Terms and Conditions (hereinafter referred to as "Terms and Conditions"), which we use as a basis for the use of the Westwing online shop as well as for personal furnishing advice (Westwing Design Services) on the www.westwing.de website. By placing your order, you accept the following terms and conditions of Westwing GmbH, Moosacher Str. 88, 80809 Munich (hereinafter referred to as "Westwing").

These T&Cs apply to consumers with a billing address in Germany or Austria who take advantage of the offers on our website. A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his self-employed professional activity.

1. GENERAL AND SCOPE

1.1 Westwing operates an online shop and personal furnishing advice on the website www.westwing.de (hereinafter referred to as "Westwing Design Services").

1.2 In order to use the offers available in the online shop and at Westwing Design Services, persons must be at least 18 years of age.

1.3 As a matter of principle, the goods and services are only sold in normal household quantities.

1.4 These GTC shall apply to all contracts concluded via the Website www.westwing.de, unless the separate B2B GTC for Entrepreneurs applies.

1.5 If (working) days are specified as deadlines, this includes all days of the week with the exception of Saturdays, Sundays and public holidays.

2. REGISTRATION AND USE OF THE WEBSITE WWW.WESTWING.DE

2.1 When ordering goods and/or services, you will be asked to submit personal data that will be collected and processed in accordance with Westwing's privacy policy. Paragraph 20 shall apply.

2.2 You are responsible for ensuring that the data is complete and true. You are also obliged to keep your data up to date. If there is a change in the data provided during the duration of your use of the website, you must correct the information immediately. You are obliged to treat your passwords and any other access data confidentially and to protect them from access by unauthorized third parties.

2.3 If you create a customer account, you will receive a confirmation of your registration by e-mail (so-called "double opt-in") after completing the registration process.

2.4 You are solely responsible for any content (such as product reviews) that you post in accessible areas. You warrant that your own content will not infringe upon or violate the rights of third parties (e.g., personal rights or copyrights). In this regard, you hold Westwing fully indemnified against claims by third parties upon first request. By transmitting the content to Westwing, you grant Westwing and all Westwing affiliated companies of the Westwing Group (hereinafter referred to as the "Westwing Group") all non-exclusive rights of use in terms of time, space and content without restriction and also for transfer to third parties that Westwing needs to publish and distribute the content, even in part, on the websites of the Westwing Group.

2.5 In your customer account, you can view your open, recently shipped and/or completed orders and, if necessary, change them, as well as manage and store your own data, vouchers, newsletters and notifications in a differentiated manner.

2.6 You may only register with one account on the Website www.westwing.de and operate only one account at a time. If Westwing detects multiple registrations, Westwing can delete them.

2.7 It is prohibited to use the Website www.westwing.de or its contents for purposes that are unlawful, abusive or prohibited by these T&Cs. In particular, technical processes must not be disrupted or manipulated. In the event of behavior or attempts to gain unjustified advantages to the detriment of Westwing or other customers, Westwing reserves the right to block the customer account and not to accept offers.

Your right of revocation according to Section 13 is in no way restricted by the aforementioned measures. Any claims for damages by Westwing remain unaffected.

3. CONTRACTING PARTIES, LANGUAGE AND CONCLUSION OF CONTRACT

3.1 The contractual partner for the conclusion of contracts on the www.westwing.de website is Westwing.

3.2 The www.westwing.de website is operated in German. Contracts via the website are concluded exclusively in German.

3.3 The offer of goods and services on www.westwing.de is not a binding contractual offer within the meaning of Section 145 of the German Civil Code (BGB), but is subject to change and is to be understood as a non-binding invitation to submit an offer (so-called "invitatio ad offerendum"). After the selected products and services have been placed in the virtual shopping cart and the electronic ordering process has been completed, you submit a legally binding contractual offer by submitting an order for the goods and services in the virtual shopping cart at that time by clicking on the "Buy now" button. After submitting your offer, you will receive an e-mail from Westwing about the receipt of your offer. This e-mail from Westwing does not constitute an acceptance of the contract. It is at Westwing's discretion not to accept offers. If an order is not fulfilled by Westwing, Westwing will inform you immediately. The contract is accepted by separate e-mail with shipping confirmation or confirmation of the provision of the service, but no later than when the goods are shipped.

3.4 Westwing stores the order data and sends it to you by e-mail after completing an order. This e-mail also contains a cancellation policy. You can also view the terms and conditions at any time under https://www.westwing.de/i/terms_and_conditions/. If you have set up a customer account before submitting your order, you can always view the order data in the login area. This also applies to past orders within the framework of the statutory retention obligations.

3.5 Order processing and contact are usually carried out by automated order processing or by e-mail. You must ensure that the e-mail address you provide for order processing is correct so that e-mails sent by Westwing can be received at this address. In particular, when using SPAM filters, you must ensure that all e-mails sent by Westwing or third parties commissioned by Westwing to process the order can be delivered.

4. PRICES AND SHIPPING COSTS

4.1 Orders for goods and services on the Website www.westwing.de will be subject to the prices set out on the relevant item detail page at the time of your order. The prices are understood as total prices including VAT and packaging. In addition, there are shipping costs and, if applicable, costs for an additionally bookable set-up service (see section 5).

4.2 The shipping costs are charged separately for each order and are based on the price stated on the product detail page. This depends on the size, weight and the respective shipping method, among other things. The latter is at the discretion of Westwing.

5. ASSEMBLY SERVICE

5.1 In the case of selected products, assembly or assembly at the desired location is offered as an additional separate fee-based service in almost all areas of Germany and Austria (hereinafter referred to as "assembly service"). Alternatively, you can book the set-up service later if you select a delivery date and tick the "Set-up service" field. In selected cities, you can alternatively book the Westwing Premium Service by selecting the "Premium Service" field when arranging a delivery date via our appointment website. By clicking on "Book an appointment" you complete the booking of the Premium Service.

Westwing does not guarantee that the goods can actually be set up or attached in the rooms provided for this purpose. Westwing reserves the right not to offer the assembly service at its own discretion in individual cases. The assembly is carried out according to the respective assembly instructions.

5.2 Westwing shall provide the assembly service at its discretion itself or through third parties (subcontractors) acting on behalf of Westwing. You are not entitled to the selection of a specific person to carry out the desired assembly service.

5.3 If you have not already agreed on a delivery date via the appointment website, you will be contacted by Westwing or a Westwing subcontractor to arrange an appointment after your order. A suitable and easily accessible environment must be ensured for the provision of the set-up service and promoted by appropriate cooperation on your part, if necessary (e.g. enabling access, sufficient space for assembly).

5.4 Excluded from the installation services are painting and wallpapering work and/or electrical installations as well as wall and ceiling installations.

5.5 When ordering the set-up service, additional costs will be charged for this service in addition to the purchase price displayed at the time of your order or on the appointment booking website.

5.6 The risk of accidental loss and accidental deterioration of the goods shall only pass to you after completion of the assembly service and handover.

5.7 Westwing and its subcontractors are entitled to carry out an acceptance test after installation and to produce photographic material for documentation.

For the refund, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you. If you have requested that the services should start during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

The right of revocation does not exist or expires for the following contracts:

  • in the case of the delivery of goods which are not suitable for return for reasons of health protection or hygiene and the seal of which has been removed after delivery or which, due to their nature, have been inseparably mixed with other goods after delivery;

  • for the delivery of goods that are made according to customer specifications or are clearly tailored to personal needs

  • in the case of delivery of goods that may deteriorate quickly or whose expiry date would be quickly exceeded;

15. VOLUNTARY RIGHT OF RETURN FOR CONSUMERS

15.1 For all purchases of goods, Westwing grants you the right of withdrawal in accordance with No. 13 also a voluntary right of return of a total of 30 days from receipt of the goods. With this voluntary right of return, you can also withdraw from the purchase contract after the expiry of the 14-day withdrawal period (see section 13) by returning the goods to Westwing within 30 days of receipt.

However, the prerequisite for exercising the voluntary right of return is that you return the goods in full, in perfect condition and without damage in the original sales packaging. Otherwise, Westwing reserves the right to refuse to take it back. We would like to point out that within the framework of the voluntary right of return, you bear the transport risk when returning the goods. The voluntary right of return does not apply to the purchase of gift vouchers.

15.2 The refund will be made to the payment method used by you for payment. If the direct debit method has been chosen as the means of payment, no objection to the direct debit is required.

15.3 Your statutory right of revocation (cf. Clause 13) shall not be affected by compliance with the requirements set out in this Clause 15 and shall remain in force regardless of this. Until the expiry of the period for the statutory right of withdrawal, only the legal conditions listed there apply. This contractually granted (voluntary) right of return also does not limit your statutory warranty rights, which you retain without restriction.

16. REIMBURSEMENT OF DELIVERY AND SERVICE COSTS IN THE EVENT OF PARTIAL REVOCATION

If you cancel the contract for only part of the goods in an order (partial cancellation), Westwing will refund the payments for the goods covered by the withdrawal, including the delivery and assembly costs (if not yet assembled). However, insofar as (parts of) the delivery and assembly costs would have been incurred even if only the goods had been ordered, for which you do not withdraw from the contract, these are excluded from reimbursement.

The goods remain the property of Westwing until full payment has been made.
